Welcome to PH6 Coffee. These Terms of Service ("Terms") govern your access to and use of the website, online store, and all related services (collectively, the "Services") operated by Aterra Ph6 Pvt Ltd, trading as PH6 Coffee ("we", "us", or "our"). PH6 Coffee is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms carefully. By visiting, browsing, or making a purchase through our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy (each linked below), form the entire agreement between you and PH6 Coffee.

Section 1 — Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence. You also confirm that you have given consent to allow any minor dependents in your care to use the Services on devices you own or manage.

To use the Services — including browsing our store, placing an order, or creating an account — you may be asked to provide information such as your name, email address, billing, payment, and shipping details. You represent and warrant that all information you provide is accurate, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or share your account with any other person. If you suspect unauthorised access to your account, please notify us immediately at support@ph6coffee.com.

Section 2 — Our Products

We have made every effort to accurately represent our products and services on our online store. However, please be aware of the following:

  • Colour and appearance: Product colours and appearances may differ slightly from how they appear on your screen due to your device type, display settings, and configuration. This is particularly relevant for packaging visuals.

  • Coffee characteristics: Roasted coffee is a natural agricultural product. Flavour profiles, colour, and aroma may vary slightly between batches due to the nature of the crop, harvest season, and roasting process. This is not a product defect.

  • Product descriptions: All descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction.

  • We do not warrant that the appearance or quality of any product will meet your individual expectations or match exactly how it is depicted in our online store.

Section 3 — Orders

When you place an order through our Services, you are making an offer to purchase. PH6 Coffee reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until PH6 Coffee confirms acceptance and processes your payment.

Please review your order carefully before submitting. PH6 Coffee may be unable to accommodate cancellation or modification requests after an order is accepted and processing has begun. If we do not accept, modify, or cancel your order, we will attempt to notify you via the email address or phone number provided at the time of ordering.

Important — Inspect your order upon delivery: Please inspect your order immediately upon receipt. If your item is defective, damaged, or incorrect, you must contact us within 48 hours of delivery at support@ph6coffee.com. Claims raised after 48 hours may not be accepted as it becomes difficult to verify the condition of the product at the time of receipt.

All purchases are subject to return or exchange solely in accordance with our Return & Refund Policy [LINK]. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price displayed at the time your order is placed and confirmed in your order confirmation email. Unless otherwise expressly stated, displayed prices do not include applicable taxes, shipping charges, customs duties, or import fees.

Prices on our online store may differ from prices offered in physical retail locations or on third-party platforms. Where we run promotions or special offers, those offers are governed by their own specific terms and conditions. In the event of a conflict between promotional terms and these Terms, the promotional terms will govern for that specific offer.

By placing an order, you agree to provide accurate and complete payment and billing information. You represent and warrant that: (i) the payment information you provide is true and complete; (ii) you are authorised to use the payment method provided; (iii) charges will be honoured by your bank or payment provider; and (iv) you will pay all charges at the posted prices, including applicable shipping and taxes.

Section 5 — Shipping and Delivery

We aim to process and dispatch all orders promptly. All delivery times provided are estimates only and are not guaranteed. PH6 Coffee is not liable for shipping and delivery delays caused by courier partners, customs processing, weather events, or other circumstances outside our control. Once we transfer products to our courier partner, title and risk of loss pass to you.

All content on our Services — including but not limited to text, product descriptions, imagery, graphics, logos, brand names, packaging designs, video, audio, and the overall look and feel of the store — is owned by or licensed to Aterra Ph6 Pvt Ltd (PH6 Coffee) and is protected under applicable intellectual property laws, including the Indian Copyright Act 1957, the Trade Marks Act 1999, and applicable international intellectual property conventions.

"PH6 Coffee", "Aterra Ph6", and associated logos and product names are trademarks of Aterra Ph6 Pvt Ltd. Shopify's name, logo, and related marks are trademarks of Shopify Inc. All other trademarks are the property of their respective owners. Unauthorised use may constitute a violation of applicable intellectual property law. All rights not expressly granted herein are reserved.

Section 7 — Optional Third-Party Tools

You may be provided with access to optional tools offered by third parties as part of the Services. These tools are neither monitored nor controlled by us. Access to such tools is provided on an "as is" and "as available" basis without any warranties, representations, or conditions of any kind. PH6 Coffee is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made through our store are made directly with Aterra Ph6 Pvt Ltd (PH6 Coffee). Shopify is not a party to any transaction between you and PH6 Coffee and is not responsible for any aspect of your purchase, including any injury, damage, or loss resulting from purchased products. By using the Services, you expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with PH6 Coffee.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATERRA PH6 PVT LTD (PH6 COFFEE), ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS — OR THOSE OF SHOPIFY AND ITS AFFILIATES — BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS OBTAINED THROUGH THE SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and PH6 Coffee regarding your use of the Services. They supersede all prior or contemporaneous agreements, communications, and proposals — whether oral or written — between you and us. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

You may not delegate, transfer, or assign this agreement or any of your rights or obligations under these Terms without our prior written consent. Any such attempt without consent is null and void. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms, your use of the Services, or any purchase made through our store shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India. You consent to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction by these courts.
